Terms of Service

1. Acceptance of Terms

By accessing or using Calibre (“the Platform”, “we”, “us”, “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must stop using the Platform immediately.

These terms form a legally binding agreement between you and Pariah Studio Pty Ltd (ACN pending), the operator of Calibre. “You” means any individual or entity that accesses the Platform, whether as a studio operator, artist, or client.

2. Service Description

Calibre is a body art studio management platform providing:

  • Online booking and appointment scheduling for tattoo and piercing services
  • Digital consent form generation and signing, compliant with NSW Tattoo Industry Regulation 2023
  • AR jewellery try-on powered by device-local rendering
  • Inventory and stock management for studio operators
  • Calibre Ledger — double-entry accounting and financial reporting
  • MYOB and QuickBooks integration for studio accounting workflows
  • Self-hosted AI-powered client recommendations and analytics
  • Brand advertising and affiliate tracking tools

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice where practicable.

3. User Accounts & Responsibilities

Account creation

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Acceptable use

You agree not to misuse the Platform, attempt to gain unauthorised access to any system or data, submit false or misleading information, harass other users, or use the Platform for any unlawful purpose.

Studio operators

Studio operators are solely responsible for ensuring their business operations comply with all applicable licensing, regulatory, and health requirements, including but not limited to the NSW Tattoo Industry Act 2012 and any applicable local council requirements. Calibre provides tools — it does not confer regulatory compliance.

4. Booking & Consent

Digital consent is legally binding

When you sign a digital consent form on the Platform, you are entering into a legally binding acknowledgement of the risks, aftercare requirements, and studio policies associated with your procedure. Ensure you read all consent material carefully before signing.

Age requirements — You must be 18 years of age or older to book tattoo services or certain piercing services. We perform date-of-birth verification at the time of booking. Studios may impose additional age restrictions. Providing false age information is a breach of these terms and may constitute fraud under applicable Australian law.

Cancellations — Cancellation and rescheduling policies are set by individual studios. Calibre is not responsible for enforcing studio-level cancellation terms, though we provide tools to facilitate them.

Record retention — Signed consent forms are retained for a minimum of three years in accordance with the NSW Tattoo Industry Regulation 2023. You may request a copy of your consent record at any time.

5. Payment Terms

Payment for services booked through Calibre is processed by Stripe, a PCI DSS Level 1 certified payment processor. All amounts are displayed and charged in Australian Dollars (AUD) unless otherwise stated.

Deposits

Studios may require a deposit at time of booking. Deposit amounts and refundability are determined by the studio and disclosed before payment.

Refunds

Refund policies are set at the studio’s discretion. Calibre does not guarantee refunds for services rendered. Disputes about service quality must be raised directly with the studio in the first instance.

Platform fees

Calibre charges studios a platform subscription fee for use of the management tools. Pricing is communicated separately during onboarding.

6. Intellectual Property

Platform IP — The Calibre platform, including its design, software, algorithms, and documentation, is owned by Pariah Studio Pty Ltd and protected by Australian and international intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Platform.

Studio data — Studios retain full ownership of their client data, booking records, and business information uploaded to the Platform. You grant us a limited, non-exclusive licence to host and process this data solely to provide the services described herein.

Artist content — Artists retain copyright in their portfolio imagery. By uploading work to the Platform, artists grant Calibre a non-exclusive licence to display the imagery within the Platform and, with explicit opt-in, for promotional purposes.

7. Limitation of Liability

To the maximum extent permitted by law, Calibre and its directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, personal injury, or property damage, arising out of or related to your use of the Platform or services booked through it.

Our total aggregate liability for any claim will not exceed the fees paid by you to Calibre in the three months preceding the event giving rise to the claim.

Nothing in these terms excludes any statutory consumer guarantees or rights under the Australian Consumer Law that cannot be excluded by agreement.

8. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of New South Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

9. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will notify registered users by email and update the “Last updated” date at the top of this page. Continued use of the Platform after changes become effective constitutes your acceptance of the revised terms.
